The Commercial Lending Practice Group at Markus Williams Young & Zimmermann incorporates an experienced legal team that works together with the firm’s Bankruptcy and Restructuring team to help banks and other lending institutions work through the complex business and legal issues that face them in structuring, negotiating, and documenting a commercial loan transaction. We have represented lenders in a wide variety of secured and unsecured transactions, including syndicated and non-syndicated cash flow and asset-based loans, acquisition financings, and capital expenditure and equipment loans, several involving cross border collateralization issues.

  • We are also well versed in documenting tailored security agreements covering special collateral, such as intellectual property, ownership interests, and deposit accounts.

  • Our attorneys offer expert advice on intercreditor and subordination issues.

  • Thanks to our deep agricultural lending team, we can help navigate the difficult and often unclear issues related to PACA and PASA.

  • In case of a failed transaction, our attorneys will work with the firm's Bankruptcy and Restructuring team, bringing to your transaction tremendous experience in workouts, liquidations, and bankruptcies.

  • Represented a national bank in secured and unsecured transactions and senior and mezzanine facilities of up to $125 million in various industries, including an international e-business integrator, a telecommunications company and a software engineering firm

  • Represented a specialized lender in credit facilities ranging in size from $80 million to $2.15 billion to power cooperatives

  • Represented a national bank in a $125 million unsecured credit facility to a technical ceramic manufacturer

  • Represented a national bank in a $75 million credit facility to an international e-business integrator
