COMMERCIAL LITIGATION

Markus Williams Young & Zimmermann’s Commercial Litigation Practice encompasses the full spectrum of commercial and business disputes, including banking and commercial finance, corporate and business, construction, insurance coverage, non-compete and trade secret, oil and gas, and real estate. We represent a diverse range of national and international companies, as well as numerous local and regional companies and individuals.

How Can We Help?

We have litigated almost every type of contractual dispute imaginable, including disputes arising from:

  • Partnership agreements

  • Syndication agreements

  • Inter-creditor agreements

  • Oil and gas disputes

  • Licensing agreements

  • Shareholder agreements

  • Landlord/tenant leases

  • Servicing contracts

  • Construction contracts

  • Loan agreements

  • Brokerage agreements

  • Condemnation proceedings

  • Equipment leases

  • Insurance agreements

  • Covenants not to compete

  • Deeds of trust

We routinely defend and prosecute actions to protect a creditor’s collateral, including actions to foreclose upon Article 9 security interests, actions to determine priority of liens, including mechanic’s liens, and actions to prevent the unlawful or unlicensed use of collateral. A recent example of such litigation was our successful prosecution to enjoin a borrower’s use of our client’s collateral in connection with a medical marijuana dispensary.

In addition to advancing our clients’ interests in federal and state courts, we also have extensive experience in alternative dispute resolution, including involvement in arbitration conducted before the American Arbitration Association and the Judicial Arbiter Group.

Why Markus Williams Young & Zimmermann?

Our attorneys bring a unique perspective to business litigation. Based on our extensive experience representing financial institutions, we understand the economics involved in a business dispute and the ways in which litigation can be used as leverage for and against our clients’ interests. We do not litigate for litigation’s sake, but to advance our client’s bottom line.
